I do have some law enforcement experience and let me tell this story from a slightly different perspective as you might read in the officer's report...

I answered a domestic disturbance call (inherently one of the most dangerous types of calls). Upon arriving I was met by a woman, the mother of the two other women there, and the mother wanted me to remove the two daughters. Before the mother could finish telling her story, a male came into the house. He was identified as the mother's brother.

<joe6pk> Before the mother could finish telling the officer the problem, the officer ordered her to shut up. The officers were anxious to hear the pretty young nieces, one of which had a warrant out for failure to pay child support. She left the scene of the officers crimes un accosted. The mother did detail how the brother was not there to cause trouble,was always welcome in the home and was ONLY there to make sure his sister was ok.</joe6pk>

I had an uneasy feeling about the male (or perhaps I noticed a bulge in the pants that made me wonder if he was armed). I asked him to step outside. I then asked him if he had a weapon. Instead of simple yes or no, he started a distracting conversation and reached for his back pocket which I could not see. I reacted immediately in a forceful manner to prevent him from withdrawing any weapon from the pocket and gave loud, verbal commands and took him to ground in the prone position. In order to do so, I attempted to disable him with a knee strike to the common peroneal nerve. At which time my partner, upon hearing the commotion, assisted me in handcuffing the male.

<joe6pk> It is an uneasy feeling which bulge the officer was observing since I am a conservative, politically incorrect heterosexual. Often referred to as homophobe, I had an uneasy feeling as well about the officers when I heard them tell my sister to shut up in her own house. Distracting conversation means exercising inalienable/unalienable Constitutional RIGHTS. Something totally foreign to this officer's thought process. Did he sign an oath to uphold it? He failed miserably ! Though the perpetrators of these crimes, both nieces and officers walked away. The brother became the victim of officers Parker and Haas. </joe6pk>


There are some misconceptions that need to be cleared up here for everybody's safety if you are ever in a similar position.

A law enforcement officer enforces the law, he doesn't make them (that is the job of the legislature) and he doesn't interpret them (that is the job of the judges). As he enforces the laws, he also has the goal of going home to his family that night in one piece.

<joe6pk> A good officer takes his oath seriously and enforces the Constitution and inclusive Bill of Rights. He generally doesn't last long in this profession. A bad officer helps in the misapplication of non law statutes to usurp the sacred RIGHTS under those precious documents. Sadly he thrives in law enfarcement. Ask the family of the murdered Ken Trentadue ! </joe6pk>

<joe6pk> Sadly, officers shouldn't go home with chips out of their knuckles either Larry. They wouldn't have to pour that burning medicine on them. I can almost feel their pain, if mine weren't so overwhelming. </joe6pk>

Remember, the officer doesn't know what you were doing five minutes ago. You could have been robbing a bank.

<joe6pk> Ever wonder why officers are supposed to obey the same Laws we Citizens do? </joe6pk>

If an officer asks you if you have a weapon, DO NOT MOVE YOUR HANDS! Keep then in plain sight. If you have something in your back pocket (or any pocket) that you wish the officer to know about or see, tell him. He will get it out for you.

<joe6pk> Definition of weapon totally unclear here, BUT ALWAYS retain RIGHTS ! No matter who tries to take them !! Is a weapon any of the following: pen, knife, fist, machete, garden shears, ball bat, lamp, automobile etc. etc. Could a dried and hardened gourd from the garden be misconstrued as a bulge and/or weapon? Be advised wether male or female the officer has now observed bulges. If you look closely, all Americans have bulges thereby making them " SUSPECT" to law enfarcement. </joe6pk>

<joe6pk> By this alleged officer's above comments, in effect he is saying: If a cop asks you a question, immediately freeze and allow an un Constitutional search and seizure. Surrender your rights. Don't move any part of your body because the officer could misunderstand, kill you and more times than not get away with it depending on available evidence & witnesses. </joe6pk>

If you reach around behind you, you will immediately, forcefully, and painfully be put on the ground. Handcuffing in the prone position if not comfortable for the person being handcuffed even if the officer is being extremely gentle. I can tell you that if I put you in the prone position, I will not be gentle.

<joe6pk> Larry, 10/4 good buddy on the painful !!! Not to mention a good beating from a militarized/police state, once known as America. If you're near my age of 51 Larry, surely you remember it. Has it dawned on you yet Larry why AmeriKa now has more prisoners than Russia, China, or anywhere else on the globe Larry? Do you remember Kruschev saying we will destroy you from within w/o firing a shot? How did he do that Larry? I Dare say your e-mail helps answer the question Larry !! Too many Officers not only don't know the Constitution, they could care less about it. </joe6pk>

In textbook fashion, to handcuff a suspect in the prone position (and that is spread eagle face down), I would take his arm straight up which is not a natural rotation, quickly come to a kneeling position with one knee at the base of his neck (it used to be taught to put it on the neck), and apply a wrist lock (which is also painful). Then proceed to bend the arm back. have the other arm brought back, and finish handcuffing.

<joe6pk> Larry, do you administer this before or after the beating ? </joe6pk>

The proper way to get somebody up from this position is to place my hand in a supporting position behind the neck and roll him up into a sitting position. (Many officers don't do this very well or don't know how to do it properly.)

A frisk or a pat down is not a search. This is for officer safety and can be done upon reasonable suspicion of a weapon.

<joe6pk> Give us a break here Larry, you've convinced yourself. Some officers pats could be another Citizens bruises !!! Trust me on this one Larry !!! Reasonable suspicion, theres that tell-tale bulge again. </joe6pk>

Now for another misconception, an officer does not have to immediately read you your Miranda rights. They must be read before questioning the suspect.

<joe6pk> Depends upon the states loose interpretation and whether a state even honors Miranda these days Larry. Also please read your own basic admission below about Joe Bob with a BADGE who signs the same oath as the good officers. </joe6pk>

I would say that the officer did a poor job of searching Mr. Weeks if he made it to the jail with a knife in his pocket.

<joe6pk> Not only that Larry, I still had some old bulges,(crotch, stomach, hips etc.) as well as some new ones. (head, throat, neck, chest, arms, gonads, back, hips, legs etc., etc. I assume you were responding to Dr. Byron Weeks. </joe6pk>


One of the problems that we, as a society, have is that many small towns and counties do not have professionally trained law enforcement officers. It is merely Joe Bob with a badge who learns via OJT. This officer is likely not to understand constitutional rights and get into trouble. He will also abuse his authority. He will also be the cause of criminals walking due to technicalities because he improperly seized evidence. This makes it look bad for professional officers.

<joe6pk> Larry, One of the problems America has is the militarization/federalization of all law enfarcement in small towns,counties and big government (FED). Example: Many church burnings were prosecuted by the federal government the past few years, few, if any had casualties. The government burns a church with women and children and mass casualties (murder) and get by with it. I know Larry,you probably think this is just sour grapes and we should let bygones be bygones. WRONG !! </joe6pk>

I do not know what kind of training officers in Anderson County undergo.

<joe6pk> I just bet you really do and it's nowhere near Constitutional, Larry. </joe6pk>


BTW, the officer has the right to meet any resistence with one level higher of force. In other words, if you pull a knife, he has the right to pull his gun. He also has the right to meet any threat or perceived threat (such as reaching behind your back) with whatever immediate force he feels is necessary. People get shot for reaching into their pockets or behind their backs.

<joe6pk> Larry,does this work in reverse for a Citizen victim ? Lets say: for the Haitian man in New York who had a broom handle run up and broke off in his rectum. Could he like use a baseball bat to return the favor to those officers? Will the millions of dollars that his lawyer and he gets ease his memory of that frightful moment? Talk about post traumatic stress disorder. Wow !! </joe6pk>

Just move slowly and keep your hands in clear sight.

<joe6pk> Don't fall for this one fellow Citizens, when you move slowly is when you get the body slam. Even if you are disabled. Hands in clear site of which officer? </joe6pk>

Hope this helps. I am not trying to cover for the officers in this incident. But I want everybody to avoid this type of confrontation when possible.

PPS . I like good Law Enforcement Larry. Problem is they're so hard to find in modern day AmeriKa.

PPSS. Maybe you could help me with some legal advice Larry, since the officers kept my drivers license for so long to punish me. Is it a moving violation getting body slammed ?
